We appreciate everything that you did for us. Being as professional as you are, and great at what you do, we're sure that you had numerous clients relying on you and your time. Yet, you never made us feel like were "just a number". You always made time for us, returning all telephone calls and pages promptly regardlss of the time of day. We feel that we actually developed a friendship with you and now that we have purchased and moved into our new home we kind of miss the communication with you. Most realtors would not have put forth the efforts you did for us in our search for a new home, without having our house to sell as part of the deal also. As renters, we didn't have that to offer to you, yet you demonstrated extreme patience and understanding and never pressured us into a sale. Being first time homebuyers, we really weren't sure exactly what it was were looking for. You never gave less then 100% of your efforts even though it took us almost six months to find our home. Even after the sale, you continued to be supportive by sending us valuable resources and information such as your "After Sale Checklist". This checklist helped our move go quite smoothly and we thank you for that also. So today, here we sit in OUR kitchen, while our children are playing in OUR living room. When two or more individuals own property together, each one owning an equal interest and having equal rights in the property including the rights of survivorship, it is referred to as joint tenancy. Any of the joint tenants may transfer his or her interest in the property to another party, but this dissolves the joint tenancy and creates a tenants-in-common interest with respect to the other parties whose names are on the title.
The most important feature of joint tenancy is the right of survivorship. A joint tenant cannot will his or her interest in the property to others. The surviving joint tenant (or tenants) simply becomes the owner or owners of the property without going through the probate process, which can involve expensive legal fees and may take months to resolve.
It is important to get professional advice when you plan to buy and hold title to real estate with another person.
